Message from the club chairman 9th October WimPen’s response

Wimpen refute the contents of this message, In short, your ownership is legal and safe and Wimpen remain entitled to sell and transfer weeks on behalf of owners.

Dear Mr Barrow

“In relation to paragraph 2, "Club membership certificates" included in the communication called "message from the club chairman" dated October 9, 2023, it should be pointed out that in neither of the two arbitrations conducted between Mr. Fletcher and his Club Committee, and Wimpen, have Wimpen's powers to manage the issuance of membership certificates been questioned.

This facility is given to Wimpen in its capacity as Founder Member of the Club in article 10.3 of the 1990 Constitution, as amended in 2014, the only valid Constitution of the Club. This article says: “both the Founder Member and the Committee shall have power to admit applicants to membership which each may exercise without reference to the other provided always that such power shall not be exercised so as to result in two Membership Certificates being granted in respect of the same Apartment and the same weekly period”.

Likewise, we can confirm that what Mr. Fletcher defines as a letter sent from the Trustee to the Club, it is not a letter issued by the Trustee nor is the opinion of the Trustee, as confirmed by the Trustee itself.

Mr. Fletcher continues to take steps to remove Wimpen from the Club, including change of the Club's constitution and the Club Committee, which he knows are absolutely illegal, as similar acts have already been declared null and void in both aforementioned arbitrations.

You can trust that both your Membership Certificate and your payment of maintenance costs in the Community account are completely legal.
